Terms & Privacy

The agreement you enter into when you order, and what we do with your data. Worth a read before you check out.

Ordering from savvycartshop.com puts you into an agreement with us. Everything that agreement contains is on this page, split into four parts: buying, using the site, liability and disputes, and privacy. Keep a copy if you want one. The privacy half is part of the same agreement, not a separate document.

Throughout, Savvy Cart Shop means us, and you means you personally — and, where you are ordering for an organisation, that organisation too.

Part one — Buying from us

Who is allowed to order

Ordering and membership are open only to people capable of entering a legally binding contract under applicable United States law. Minors may not become members. Using the site also means keeping to United States law, regulations and rules, and to everything set out here and in the policies referenced from here.

Submitting an order authorises a charge to your card for whatever you selected, taken at the time you place it.

If you chose a subscription

Choosing a subscription option enrols you in monthly recurring billing. The first charge is taken immediately and repeats every 30 days until you cancel. Ahead of each repeat you get an electronic notification 5 to 7 days beforehand, and a receipt lands after each successful charge.

Choosing a Subscribe and Save product specifically means agreeing to all of the following:

Changing your mind

Not satisfied with your subscription? You have 30 days from the time of the order to ask for a refund. Reach customer service through the contact form or at [email protected]. The money is credited back to your bank account, and may take up to 3–5 business days to appear on your statement depending on how fast the processing bank moves. The same address is the right one for questions, or if a product turns out not to suit you.

When a listing is wrong

We work at keeping what is published here complete and correct, but typographical slips, mispriced items and other inaccuracies do happen. We take no responsibility for those errors, and we keep the right to correct any error, inaccuracy or omission and to withdraw any offer stated on the site.

Order screening

Credit card fraud, actual or suspected, may be reported and prosecuted by us, though we are not obliged to do so. We may ask for further authorisation, telephone confirmation of an order among the possibilities. The order process captures information including time, date and IP address, which can be used to locate and identify people committing fraud. Where fraud is suspected we may cancel an order, delay it, refuse to ship it, or recall it.

Part two — Using the site

What you may do here

Subject to these terms, you hold a limited, non-exclusive right to use the content and materials published here in the normal course of using the site. Reverse engineering any of the technology behind the service is not permitted.

Anything you post or send us

Post, store or transmit content on or to this website and you grant us a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable right and licence to use, copy, display, perform, create derivative works from, distribute, transmit and sublicense it, in any form and in any media now existing or later invented. Your interactions with other users, and anything you post, remain your responsibility alone.

Feedback is treated differently and more simply. Comments, suggestions, ideas and other submissions you offer us in connection with your use of the site become our exclusive property; offering them assigns to us all worldwide right, title and interest in them.

Our marks and materials

The logos, design, text and graphics here — and the way they have been selected and arranged — belong to us, or to our suppliers or licensors. Savvy Cart Shop is a trade name we own, as are the related design marks and other trademarks appearing on the site. None of it may be used without our express written permission.

That extends to how you link to us. Deep linking into parts of the site is not allowed, nor is framing, inline linking or any similar display of our property, and our logos and trademarks may not be built into a link without written permission.

Links that lead off-site

Some links here point to sites owned and run by other people. Their information, products and services are outside our control, and a link is not an endorsement. We carry no responsibility or liability for whether those external sites work or stay available.

Part three — Risk, liability and disputes

What is and is not warranted

The site, the products and the services come to you as is and as available. We disclaim the implied warranties, fitness for a particular purpose, merchantability and non-infringement included. Anything health-related published here is information only and is no substitute for advice from a doctor or another health care professional. Whatever happens, our total liability will not exceed the greater of $100 or the sum you actually paid for the products.

Your indemnity

You agree to defend and indemnify the site along with its subsidiaries, affiliates, directors, officers, agents, members, shareholders, partners, employees and ad partners, and to hold them harmless from liabilities, losses, actions, damages, claims and demands — reasonable attorneys' fees among them — arising out of your content, your use of the service, your breach of this agreement, or your infringement of anyone else's rights.

How disputes get resolved

Every dispute arising out of or relating to these terms or your use of the site is resolved exclusively by confidential binding arbitration. Agreeing to these terms irrevocably gives up any right you might otherwise have to combine your claim with other people's as a class action; claims are brought individually. A claim must also be filed within one calendar year of arising, after which it is barred for good.

Part four — Privacy

Scope

This privacy policy applies to your use of this website and to any content, products or services reachable through it, and it may be amended from time to time. Visiting the site and asking us for information, products or services signals your agreement to it. The site is meant for users in the United States, and this policy is read under United States law.

Two things we do not do

We do not sell personal information to third parties. We do not share it with third parties either, unless the customer has given permission.

What reaches us, and when

Personal information may come to us when you hand it to a third party that we later acquire it from, when you claim a prize or redeem an offer, when you ask customer service for help, or when you sign up voluntarily to a service or a newsletter. Typically that means a name, an email address, a street address, a telephone number and similar details. Cookies and web beacons let us tie certain internet-related information about you to what is already in our database, and to tailor what you see.

Card and bank details

Credit card and bank account information submitted to us is encrypted and protected using SSL encryption software, and is used to process and complete the transaction you asked for.

People under 18

Collecting personal information about anyone under 18 is something we will never knowingly do. Should we find out that we hold such information, it is deleted from our database immediately.

Getting off our email lists

Each email carries unsubscribe instructions at the foot of the message, which will remove you from that particular list. To come off every list at once, email [email protected]. Writing to that same address is also how you ask for your information to be removed from our database.

Legal demands

We will use or disclose your personal information where a subpoena, court order, warrant or other legal process requires it; where it is needed to establish or exercise our legal rights or to defend against a legal claim; and where investigating, preventing or acting on illegal activity or suspected fraud calls for it.
